Justice Rajan Gupta and Justice Mohit Kumar Shah of the Patna High Court issue notice to the Director-General of Police, Bihar

The In-Charge District and Sessions Judge, Madhubani wrote a letter on November 18, 2021, to the Patna High Court, wherein it spoke about a physical assault and verbal abuse on Shri Avinash Kumar, Additional District and Sessions Judge, Jhanjharpur in his chamber at 02:00 P.M. at the hands of Gopal Krishna, SHO and Abhimanyu Kumar Sharma, Sub-Inspector of Police; additionally, the letter recorded the two police officers taking out their service revolvers to attack the judge, but the nearby advocates and court clerks intervened to save the life of the judge.

A two-judge bench of Justice Rajan Gupta and Justice Mohit Kumar Shah of the Patna High Court held that the said assault jeopardizes the liberty and independence of the judiciary.

The bench listed the matter for November 29 while issuing a notice to the following in light of the enormity of the issue:

  1. Chief Secretary, Government of Bihar, Patna.
  2. Director-General of Police, Bihar.
  3. Principal Secretary of Home Department, Government of Bihar.
  4. Superintendent of Police, Madhubani.
